Heard.

2] The applicant/appellant is seeking to condone delay of 355 days in filing appeal against judgment and order dated 14/11/2024 passed by the Sessions Judge, Chandrapur, in Sessions Case No. 15/2023.

3] The Counsel for the applicant submits that delay has occurred because of various reasons, one of which is confinement of the applicant in prison. He has restrictions on movement as also on collecting documents. The restrictions further affected communication with the Counsel. He further submits that there were financial constraints as well.

4] The learned A.P.P. has opposed the application saying that delay is not properly explained. However, the plea put forth by the applicant appears to us a reason sufficient to condone the delay.

5] The application is, accordingly, allowed. Delay is condoned.

CRIMINAL APPEAL ST. NO. 71/2026

6] Admit.

7] The learned A.P.P. waives notice for the respondent/State.
