DATED : 13th AUGUST, 2025 P.C. :-

2. Mr. Bankapur, learned Advocate appearing for the Appellant in

Criminal Appeal No.1745 of 2019 submits that his client is in jail.

Expeditious hearing of the Appeal has already been granted by this Court.

Therefore, the Appeal be heard. Since two Criminal Appeals, as noted

above, arise out of a common Judgment and the Appellant in one of the

Appeals is absconding, we are of the view that until the said aspect of the

matter is resolved, final hearing of the Appeals may not be possible.

3. Ms. Kaushik, learned A.P.P. for the Respondent-State to obtain a

report from the police indicating as to whether the Appellant in Criminal

Appeal No.1725 of 2019 is in fact absconding and if so, what steps have

been taken by the police to re-arrest him. The report be placed on record

within four weeks from today.

4. Stand over to 18th September, 2025.

(SHYAM C. CHANDAK, J.) (SUMAN SHYAM, J.)
