1. We have perused the judgment delivered by a Co-ordinate Bench

of this Court (Coram : Mangesh S. Patil and S.G. Chapalgaonkar, JJ.) dated

03.03.2023, in Writ Petition No.9421/2022 (Pooja w/o. Kalyan Sapate V/s.

State of Maharashtra and Others). We have also perused the order dated

04.10.2023 passed by this Court at the Principal Seat (Coram: Devendra Kumar

Upadhaya, Chief Justice and Arif S. Doctor, J.) in PIL No.132/2022 and a large

group of cases which were transferred to the Principal Seat. The present

Petitioner before us was also one of the Petitioners before the Principal Seat in

Writ Petition No.8340/2023.

2. The learned AGP submits that the affidavit in reply would be filed

in the Registry, in this application. Leave to file rejoinder affidavit along with

documents on or before 02.02.2024. He further submits that the learned GP is

not available today.

3. The learned senior advocate representing the Petitioner /

Applicant submits that considering the aforesaid orders, though things have not

moved for the last four months, the State is likely to float the tenders and issue

work orders.

4. In view of the above, stand over to 09.02.2024 in the same

category. Until then, the State Government may complete the process of

formalising the terms of the tender, but would not publish the tenders for

calling bids without the leave of the Court.
