01. Heard learned Counsel for the applicant. This is an application for condonation of delay of 78 days caused in filing appeal against judgment and order dated 17.08.2023 passed by learned Sessions Judge, Jalna in Sessions Case No. 133 of 2022. The reasons for delay are reflected in para No.2 of the application.

02. In view of the reasons stated in the application, the delay so caused is condoned. The Criminal Application is allowed.

03. Issue notice to the respondent in the appeal, returnable on 31.01.2024. Learned APP waives service of notice for the respondent/State.
