Mr. Damle, learned AGP, upon instructions, makes a statement, that similar judgment which hold what has been held in Writ Petition No.4430 of 2022, decided on 03/03/2023, is under challenge before the Hon'ble Apex Court vide SLP (Civil) Diary No.2461 of 2023, in which by an order dated 24/04/2023 the impugned judgment therein dated 24/08/2022, which takes a similar view has been stayed, considering which list the matter on 03/09/2024.
