1. On 13th September, 2022, the following order was passed :-

"1. Heard the learned Counsels for the parties.

2. Mr. Kapadia, the learned Counsel for the plaintiff seeks leave to tender an additional affidavit indicating the amount received from the defendants till date.

Leave granted.

3. Additional affidavit is taken on record.

4. Mr. Kapadia and Mr. Kadam, the learned Counsel for the defendants jointly submit that the parties would explore the possibility of an amicable resolution of the dispute.

5. At the joint request of the Counsels for the parties, list on 22nd September, 2022."

2. Today when the matter is called out, Mr. Ranjeev Carvalho, learned

counsel appears for the Plaintiff and submits that the amicable settlement has

not gone through.

3. Mr. Sanjeev Kadam, learned counsel for the Defendants would firstly

submit that the additional affidavit indicating the amount received from the

Defendants has not been received from him till date. Learned counsel also

submits that out of the principal amount Rs.30,00,00,000/- claimed by the

Plaintiff a sum of Rs.31,00,00,000/- alongwith interest has already been paid to

the Plaintiff. Mr. Carvalho seeks to verify the same.

4. Be that as it may, for the learned counsel to take updated instructions, list

on 25th October, 2023.
