1. Issue notice to the respondent, returnable on 25th April 2023.

2. By the impugned judgment, the applicant has been convicted for offence under section 427 of the Indian Penal Code, 1860 for period of two months.

3. The applicant states that he has deposited amount of Rs.60,000/- as directed by the learned Magistrate.

4. Considering the period of imprisonment and the nature of material against the applicant, the applicant has made out the case for suspension of sentence. Until further orders, the sentence imposed by the learned Judicial Magistrate First Class, Court No.2, Islampur in Summary Criminal Case No.310 of 2016 under section

427 of the Indian Penal Code, 1860 confirmed by the judgment and order dated 21st March 2023 by learned Session Judge, Islampur in Criminal Appeal No.22 of 2017 stands suspended on the same terms and conditions which was imposed on the applicant during pendency of the appeal.
