It is submitted by the learned counsel for the petitioner that in terms of paragraph 92 of the judgment of the Hon'ble Supreme Court in the case of The State of Maharashtra Versus Keshao Vishwanath Sonone [2021 (4) All MR 784 (S.C.)], the Scrutiny Committee ought to have considered the petitioner's affinity with 'Gond' tribe. However, the Committee has examined the aspect of affinity with 'Gond Gowari'.
2. Issue notice to the respondents returnable in four weeks.
3. Learned Assistant Government Pleader Shri A.A. Madiwale waives service of notice for the respondent no.1.
4. The record of the Scrutiny Committee be obtained for perusal.
5. The service of the petitioner shall not be disturbed only on account of the order of invalidation.
6. To be heard alongwith Writ Petition Nos.1851 of 2023 and 4567 of 2022.
