1. This is a petition filed under Article 227 of the Constitution of India

impugning the decision dated 16 th July, 2022 passed by the Appellate

Bench of the Small Causes Court in Marji Application No.583 of 2014 in

R.A.D. Suit No.1836 of 2010 rejecting Petitioners' application for leave

to file an appeal against a judgment and decree dated 18 th July 2012 in

the said suit.

2. Mr.Chitnis, learned counsel for the Petitioners would submit that

rejection of the application would lead to multiplicity of proceedings if the

suit was to be filed instead of the appeal.

3. Having heard the learned counsel and having perused the impugned

decision, issue notice to the Respondents returnable on 8th August, 2023.

4. Let the office objections be removed by the next date.
