1. By order dated 4th October, 2023 this Court had directed

that the impugned judgment and order dated 31 st July, 2023 passed by

the Judge, Family Court, Solapur in Petition No.A-171 of 2017 shall

remain stayed. This order was passed before issuing notice to the

Respondent. The Respondent has now appeared and has stated that

there is no requirement for the aforesaid stay to continue, as he

undertakes to the Court that he shall not remarry until further orders.

2. In these circumstances, we accept the aforesaid undertaking

and direct that the Respondent-Husband shall not remarry till further

orders. To this extend the order passed by this Court on 4 th October,

2023 stands modified.

3. Both parties before us have stated that the parties be

referred to mediation at Solapur to try and see if they can resolve their

disputes in mediation.

4. In these circumstances, the parties are referred to the

mediation centre in the Family Court at Solapur. The Mediator shall file

his/her report in this Court on or before 31st March, 2024.

5. The Registry is directed to forward a copy of this order to

the mediation centre, Solapur.

6. The parties are also directed to remain present before the

mediation centre on 8th January, 2024 at 11.00 a.m., when the

concerned Mediator will give further directions as to how the mediation

will proceed.

7. We now place the above matter on board on 5 th April, 2024

for directions.

8. This order will be digitally signed by the Private Secretary/

Personal Assistant of this Court. All concerned will act on production by

fax or email of a digitally signed copy of this order.
