Heard Mr. Patil, learned AGP for the petitioners/State.

2. The contention is that since the Government Resolution dated 31.01.1996 is being taken assistance of, for claiming permanency the requirement thereof of the respondent having worked for a period of 240 days every year for a period of five years from 01.11.1989 has not been complied with, for which the calculations made in para-5 of the petition are being relied upon.

3. Since it is contended, that earlier two litigations namely Complaint ULP No.558/1996 and Complaint ULP No.35/1999 filed by the respondent for the same purpose had been dismissed, & the respondent was not entitled to file the Complaint ULP No.99/2018 on the same ground, 2 20.WP.8090-2023.odt

considering which, issue notice for final disposal to the respondent, returnable on 19.12.2023.

4. The petitioners shall serve the respondent by all modes permissible in law.

5. Since there is a substantial delay in challenging the impugned judgment dated 12.09.2022, the petitioners in order to show their bonafies to deposit a costs of Rs. 25,000/- (Rs. Twenty Five Thousand Only) in this Court by 15.12.2023.

6. Till the returnable date there shall be ad interim stay in terms of prayer clause (G).
