It is submitted by the learned counsel for the petitioner that Original Application No.18/2016 came to be decided and allowed on 31.5.2019 in view of the earlier judgment of the Maharashtra Administrative Tribunal in Original Application No.1091/2015 decided at Mumbai. Attention is invited to the judgment of the Division Bench in Writ Petition Stamp No.9195/2021 (Manoj Mohan Mahind & Ors. V/s State of Maharashtra & Ors.), with connected matters, to point out that the judgment of the Tribunal now stands modified.

3. Issue notice to the respondents returnable in three weeks.

4. Ms. N.P. Mehta, learned Assistant Government Pleader waives notice for respondent No.2.

5. Service on respondent No.1 by all modes is permitted.
