2. In the complaint, petitioner No.1 has been described as Company Secretary and not Director. In so far as, petitioner No.2 Form DIR 12 is placed on record which indicates that petitioner No.2 is Independent Non Executive Director. The case of petitioner No.2 is prima facie covered by judgment in the case of Sunita Palita and Ors Vs. Panchami Stone Quarry, reported in 2022 SCC OnLine 945.

3. There shall be ad-interim relief in terms of prayer clause (iv) till 12th July, 2023.
