1. Learned APP submitted that, the Applicant has already been

convicted by the learned Additional Sessions Judge and DJ-1, Islampur,

District Sangli in Special (POCSO) Case No. 8 of 2020 by its Judgment and

Order dated 29th September 2021. The Applicant has already preferred an

Appeal No.845 of 2021 before this Court.

In view of the aforestated fact, present Application for quashing of

charge-sheet in FIR No. 23 of 2020 is wholly misconceived.

2. Mr.Kalel, learned Advocate for Applicant therefore on instructions

seeks leave to withdraw present Application with liberty to pursue the

Criminal Appeal No. 845 of 2021.

Leave and liberty granted.
