1. Considering that the learned Full Bench at
Nagpur has closed the matter for judgment in view of the
reference made to it, propriety demands this petition may
be kept pending till the said verdict is pronounced.
2. Nevertheless, the learned Advocate for the
petitioner relies upon the view taken by the Hon'ble
Supreme Court on 23rd March, 2022 in Civil Appeal No.
1965 of 2022 (Laxmikant and others Vs. the State of
Maharashtra and others) wherein it is concluded that once
the period prescribed after service of notice under Section
5540.21WP
127 of the Maharashtra Regional and Town Planning Act,
1966, has expired, there can be no extension of time.
3. In view of the above, we grant liberty to the
litigating parties to circulate this petition after the learned
Full Bench has pronounced the verdict at Nagpur.
