This is an application for condonation of delay in preferring appeal for challenging judgment and order of conviction of the appellant. Though this application comes for the first time, in our view this application can be decided today itself.

2. Heard learned Advocate for the applicant and learned APP for State, who appears by waiving service. Learned APP graciously submits that the application can be consider favorably. We appreciate the stand taken by learned APP. Since the applicant is in jail that itself is good ground for allowing this application for condonation of delay.
