1. It is not in dispute that the defendant-company is presently before
the NCLT.
2. The learned counsel for the defendant submits that the moratorium is
still in force and accordingly, this matter ought not to proceed.
3. On behalf of the plaintiff the learned counsel submits that a claim has
already been filed before the NCLT.
4. In view of the above, Summons for Judgment is disposed of with liberty
to file fresh summons for judgment if the occasion so arises.
