IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD
905 WRIT PETITION NO. 10263 OF 2019
SHIVAJI BUVAJI BELEKAR
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS
...
Advocate for Petitioner : Mr. T.R. Daware h/f. Mr. A.G. Talhar
AGP for Respondent Nos. 1 to 4 : Mr. S.R. Yadav - Lonikar
Advocate for Respondent No. 5 : Mr. V.S. Bedre
CORAM : A.S. GADKARI & S.G. MEHARE, JJ.
DATE : 26TH FEBRUARY, 2022.
P. C. :-
1] The present petition was heard on 21.2.2022 and was closed for orders. At the time of dictation of judgment, it was revealed that, the contention of the learned counsel for the petitioner that, the issue involved in the present petition is squarely covered by a decision of the Coordinate Bench dated 28.1.2019 in Writ petition No. 1136 of 2016 and connected writ petitions is not proper. In the said judgment, this Court has not taken into consideration the Government Resolution dated 20 th April, 2017 issued by the School Education and Sports Department, on which learned AGP had placed reliance.
In view thereof, we find that further hearing of the petition is necessary.
2] We therefore recall the order dated 21.2.2022. 3] Place the petition for further hearing after two weeks.
[S.G. MEHARE] [A.S. GADKARI]
