PER COURT :-
1. Heard.
2. The learned counsel for the applicant submits that
the applicant/original respondent no.3 is no more. He
died during the pendency of the criminal appeal
preferred by the State against the judgment and order of
acquittal. This application is fled by the wife of
respondent no.3.
3. By order dated 18.1.2022 we have requested the
learned APP to take specifc instructions about the

contentions raised in this application from the
investigating offcer.
4. The learned APP, on the basis of the report in
writing received from the Investigating Offcer submits
that, the respondent no.3-Dilip Jadhav died during the
pendency of the criminal appeal preferred by the State
against the judgment and order of acquittal.
5. In view of the same, criminal application is allowed
in terms of prayer clause 'B'. Criminal appeal stands
abated against respondent no.3 deceased Dilip Shankar
Jadhav.
