ORAL JUDGMENT


Rule. Rule made returnable forthwith. Heard finally

by the consent of the learned counsel appearing for the parties.

(2) An alternate prayer has been made by way of an

amendment carried out to this petition today and it is about disposal of

the discharge application (Exh.27) in a time bound manner by the

concerned Court, which appears to be pending for last six years.

(3) We are of the view that this alternate prayer would

serve the cause of justice and therefore, we direct the concerned Court

i.e. the Court of 6th Additional Sessions Judge, Nagpur, on whose file

this case is pending to hear and dispose of the discharge

application(Exh.27) in accordance with law, as expeditiously as

possible and in any case within three months from the date of

appearance of the petitioner and also the co-accused before him.

(4) The petitioner shall appear before the concerned

Court on 3rd January, 2023. The petitioner shall inform his co-accused

to remain present before the concerned Court on the said date. We

also request learned APP to inform the concerned Investigating Officer

to ensure that the co-accused attends the concerned Court.

(5) Writ Petition is partly allowed in above terms.
