1. Matter is partly argued by the learned Counsel for the
petitioner.
2. Mr. Yawalkar, learned A.G.P. seeks time to cite judgments in
support of the rival contention that the offence committed by the
petitioner under Section 302 of the Indian Penal Code is an offence
against the State and thus, the impugned order passed by the
respondents withholding the pension of the petitioner is justified.
Since the issue involved requires further consideration and further

arguments, we grant an opportunity to the learned A.G.P. to cite the
relevant judgments for consideration before this Court on the next
date. Copies of such judgments shall be served on the learned
Counsel for the petitioner and respondent no.6.
