3. There is delay of 1 day in filing the first appeal. It is caused due to the time consumed in making arrangement for deposit of mandatory deposit and Court Fee. The reasons are genuine.

4. Considering one day delay, I deem it proper to condone it without issuing notice to the respondents. Because much time will be consumed in hearing the respondents and then to condone the delay. Hence, delay of one day is condoned.

1. Heard.

2. Stay is granted to the execution of Judgment and Decree, subject to deposit of entire decretal amount in this Court within a period of eight weeks.

4. Original claimants / present respondent Nos.1 and 2 are at liberty to apply for the withdrawal.
