      P.C. :

                        This is an application seeking permission for renewal

      of Passport issued to the applicant.


      2                 The applicant has prayed that respondent no.3 be

      directed to consider the application of the applicant's for renewal

      of Passport for 10 years.


      3                 The application is moved before this Court since the

      Appeal preferred by the applicant challenging the judgment and

      order of conviction passed by Special Judge, Pune, vide judgment

      and order dated 28th December, 2017, convicting the applicant for

      the ofence punishable under Section 7 read with Section 13(2),

      13(1)(d) of Prevention of Corruption Act, which is pending before

      this Court. The sentence of imprisonment have been suspended.

      The learned counsel for the respondent submits that in view of

      the Notifcation dated 25th August, 1993, with regards to renewal

      of Passport, at the most, the renewal can be granted for a period

      of 5 years.


      4                 The Appeal against conviction preferred by the

      applicant is pending in the Court. Considering the factual

      aspects, the application can be allowed by directing respondent

      no.3 to consider the application of the applicant for renewal of

      passport for 5 years.


                                    :: O R D E R ::

(i) Respondent no.3 shall consider the application of

the applicant for renewal of Passport for a period

of fve years;

(ii) Interim Application No.615 of 2021, is disposed of.
