PER COURT :-


Learned counsel for the petitioner has tendered across the Bar

photocopies of Judgments. The same are taken on record.

2. Heard learned counsel for the petitioner for sometime. Seen the

Police report. Learned APP has produced a communication of

Superintendent of District Prison. Among other reasons there is reason

that surety named by him is not agreed to stand as surety. Further, he is

convicted for the offences punishable under Sections 302, 307 and 376 of

the Indian Peal Code. This is apparently heinous crime is committed and

that circumstance also cannot be ignored. However, in the past when he

was released from jail he was returned to jail late by 728 days, all these

circumstances need to be considered.

3. When there is aforesaid seriousness, in view of the circumstances

that father of the petitioner is dead, this Court expressed that petitioner

can be allowed to go to the place where he wants to perform the religious

last rites ceremonies, on account of death of his father in police escort.

For that, he needs to spend for conveyance of escort, etc. and period can

be fixed for taking him that particular place. After religious last rites

ceremonies are over, he will be taken back to the Jail and to that extent

this Court can pass order. Learned counsel for the petitioner seeks time

to collect the information from his clients.
