 1                The petitioner is having a licence to run Fair Price

Shop. Pursuant to the show cause notice dated 07 th November,

2019, his licence was suspended by order dated 26 th November,

2019. However, on 24th February, 2020, the District Supply

Officer, Nanded has given another notice by referring to

re-inquiry report of the Tahsildar, Biloli.

2 The learned Counsel for the petitioner submits that

pending inquiry of the frst notice when his licence was

suspended, the second notice was issued levelling serious

charges against the petitioner and the petitioner's licence to

run the Fair Price Shop was cancelled. Being aggrieved by the

same, the petitioner has approached the Deputy Commissioner

(Supply), Aurangabad, by fling a Revision and by judgment and

order dated 23rd September, 2020, the Deputy Commissioner

(Supply), Aurangabad, has allowed the Revision fled by the

petitioner and quashed and set aside the order passed by the

District Supply Officer, Nanded dated 05 th March, 2020. The

learned Counsel submits that however, Respondent No.5 herein

has fled second Revision before the State and by judgment and

order dated 22nd January, 2021, the learned Minister has partly

allowed the said Revision and confrmed the order passed by the

District Supply Officer, Nanded, with certain consequential

directions.

3 In view of the above, issue notice to the respondents,

returnable on 23rd February, 2021.

The learned AGP waives notice on behalf of

Respondents No.1 to 4.

Mr.Bilolikar, advocate waives notice on behalf of

Respondent No.5 and seeks time to fle reply.
