P.C.:-

1. At the outset, learned counsel for the Applicant seeks leave

to amend the cause title so as to add the complainant as party

Respondent No.2. Leave is granted. Amendment to be carried out

forthwith.

2. This is an application under Section 389 of the Code of

Criminal Procedure, 1973, for suspension of substantive sentence

imposed by judgment dated 22/10/2021 passed by the learned

Megha 6_apeal_959_2021 with IA_2832_2021.doc

Special Judge and Additional Sessions Judge, Pune in Atro. Spl. Case

No.44 of 2015, and to enlarge the Applicants on bail. The maximum

term of imprisonment is of 6 months.

3. Learned counsel for the Applicant states that the fine

amount has already been deposited.

4. Considering that the sentence imposed is of short term

imprisonment, the Applicants are granted interim bail till the next

date of hearing.

5. The Applicants shall be released on interim bail till the

next date of hearing on furnishing PR bonds in the sum of

Rs.10,000/- each with one or two sureties each to the like amount.

6. Stand over to 10/01/2022.

7. Issue notice to Respondent No.2, returnable on

10/01/2022. Learned APP shall make an endeavour to serve

Respondent No.2 through the officer of the concerned police station.
