Our attention is invited to the judgment dated 1 st October, 2021

in Writ Petition No.1277 of 2021 filed by the petitioner. This Court has

set aside the impugned communication which was subject matter of

that matter and remanded the matter back for consideration after giving

an opportunity of hearing to the petitioner by following of the

principles of natural justice. This Court granted interim protection to

the petitioner till the decision would be taken by the respondent no.1 KVM

79 - WPL 28902 OF 2021.doc and for a period of two weeks from the date of communication if the

order is against the petitioner. Pursuant to the said order passed by this

Court, the respondent no.1 passed an order against the petitioner on 3 rd

December, 2021 taking adverse decision against the petitioner.

2. The matter requires consideration. In our prima facie view, order

passed by the respondent no.1 is illegal.

3. Rule. Mr.Misra, learned counsel waives service for the

respondent nos. 1 and 2. Mr.Rodrigues, learned counsel waives

service for the respondent nos.3 and 4.

4. There shall be interim relief in terms of prayer clause (e).

Hearing is expedited.
