2. Mr.Bhavake, learned counsel for the petitioners strongly placed reliance on the judgment of this Court delivered on 16 th July 2021 in case of Shital Kumar Patil Vs. State of Maharashtra & Ors. and other connected matters and would submit that issue involved in this case are no longer res integra in view of the said judgment and several other judgments.

3. Learned AGP to take instruction as to whether issues involved are covered by the judgment of this Court and to make an appropriate statement before this Court.

4. Place the matter High on Board for 'Directions' on 8 th December 2021.
