After hearing the learned counsel for the rival parties, this Court is of the opinion that it would be appropriate that learned counsel appearing for petitioner should place before this Court judgments pertaining to the question as to pre-requisites for a direction for recounting of votes. This is in the context of a specific contention raised on behalf of the petitioner that in the present case recounting of votes was warranted under Rule 35 of the Bombay Village Panchayat (Election) Rules, 1959.
