1. Heard learned counsel for applicant as well as State.

2. This is an application seeking condonation of delay for a

period of 2 years and 268 days in fling the frst appeal against the

common judgment dated 26th March, 2018, passed in Land

Reference No.35 of 2015, by the learned Civil Judge, Senior

Division, Nashik.

3. Learned counsel for applicant/appellant submits that

the applicant is an agriculturist and is residing at village place

Hattipada (Nanashi), Tal. Dindori, Dist. Nashik and that

applicant/appellant was not aware about the impugned judgment

and order passed by the Learned Single Judge, Senior Division,

Nashik, in Land Reference No.35 of 2015 and that he was also not

aware about the provisions of Law of Limitation.

4. In this view of the matter, issue notice to the

Respondents, returnable on 16/09/2021. Mr. Yogesh Dabke,

Learned AGP for the State, waives service of notice on behalf of

respondent No.1.

5. List the matter on 16/09/2021.

6. Learned counsel for applicant/appellant also seeks

permission to serve the application by private service. Private

service is permitted. Applicant/appellant to fle affdavit of service

with tangible proof before the next date.
