2. Heard Mr. Damle, learned Counsel for the Applicant /

Appellant. He seeks stay to the execution and implementation of the

Judgment and Award passed by the learned Joint Civil Judge, Senior

Division, Alibag, in L.A.R. No.30/2001 with an undertaking that the

entire amount of Award up-to-date with interest will be deposited in the

executing Court within one week from today.

3. As such, there shall be ad-interim relief in terms of prayer

clause (a) of the Application.

"a. Pending the hearing and final disposal of the present First Appeal, the execution and implementation of the judgment dated 1/11/2017 be stayed."

4. If the Appellant fails to deposit the amount as above, the ad-

interim relief shall stand vacated without further reference to the Court.

5. After depositing the amount, liberty to the Claimant /

Respondent to seek withdrawal by moving appropriate application.
