ORAL JUDGMENT (Per : Smt.Vasanti A Naik,J)

By this writ petition, the petitioner has sought a declaration that Maharashtra Ordinance no. XIV of 1997 dated 06.08.1997 is unconstitutional. The petitioner has also sought a direction prohibiting the respondents from granting any permission for the use of playgrounds in Mumbai for purposes other than the purpose of recreation of the children and similar recreational purposes. A direction is sought against the respondents to cancel and revoke the permissions granted to Khar gymkhana ground for holding functions.

The policy of the Government must have changed during the past 20 years. The cause for filing the writ petition must have been rendered infructuous due to passage of time. That could be the reason for the absence of the counsel for the petitioner when, this matter is called for hearing.

In the circumstances of the case, we dispose of the writ petition with no order to costs.
