IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD
WRIT PETITION NO. 9962 OF 2012
PANDHARINATH RAMBHAU KORDE
VERSUS
RAMBHAU HARI KORDE AND OTHERS
Advocate for Petitioner : Shri Mahesh Shinde
h/f Shri N.V. Gaware.
CORAM : RAVINDRA V. GHUGE, J.
Dated : 28th July, 2017 PER COURT :
1. Respondent Nos. 19 and 20 have not been served despite
notice having been issued on 10/05/2013. By order dated
04/10/2013, the petitioners were directed to take steps for
service of unserved respondents failing which the matter would
be dismissed as against the said parties. Record reveals that
several opportunities were granted and even after a passage of
four years, respondent Nos. 19 and 20 are yet to be served, as
no steps are taken. The ex-parte ad-interim order granted on
06/12/2012 is continued.
2. Considering the above and since the petitioner again
makes a request, the same is refused. This Writ Petition shall
stand dismissed as against respondent Nos. 19 and 20.
Needless to state, the ad-interim order of this Court would not
bind respondent Nos. 19 and 20.
( RAVINDRA V. GHUGE, J. ).
