ORAL JUDGMENT (PER SMT. V.K. TAHILRAMANI, J.):-
Heard both sides.
2. The petitioner preferred an application for furlough
on 31/8/2016. The said application came to be rejected by order
dated 15/12/2016. Being aggrieved thereby, the petitioner
preferred an appeal. The appeal was dismissed by order dated
12/6/2017, hence, this petition.

3. One of the grounds for rejecting the application for
furlough is that he has been convicted in a case of kidnapping.
Notification dated 23/2/2012 states that if a prisoner has been
convicted for the offence of kidnapping, he shall not be released
on furlough. In view of the Notification, we are not inclined to
interfere. Hence, rule is discharged.
