ORAL JUDGMENT (Per R.M.Borde, J.) :
1 Heard. Rule. Rule made returnable forthwith and
heard finally by consent of learned Counsel for respective parties.
2 The facts giving rise to these petitions are admittedly
identical to the facts of the decided matter by the Hon'ble Apex

Court in Civil Appeal No.10513 of 2016 on 13th July, 2017, in
the matter of Monu Tomar Vs. Union of India & others.
3 All the petitioners herein participated in the selection
process for admission to the post of Postman/Mail Guard
conducted by the respondents. The examination was conducted in
Maharashtra on 29.03.2015 and results of the examination were
declared in the month of March 2016. All the petitioners have been
declared successful at the examination and after having gone
through medical examination, they have been issued selection
letters. Some of the petitioners have in fact completed the training
and also reported on duty. However, some of the petitioners have
not undergone the training.
4 Respondent No.3 - The Assistant Director, Postal
Services (Recruitment), Maharashtra Circle, Mumbai, on
25.11.2016, on the official website of the department, declared that
the results of the examination for the direct recruitment of
Postman/Mail Guard held on 29.03.2015 and for MTS held on
03.05.2015 stand cancelled with effect from 25.11.2016. It was also
declared that the process for recruitment will be initiated afresh.
5 It appears that the action of cancellation of selection
process was taken in view of suspected involvement of examinees
in the malpractices at the examination. It was reported that
malpractices have taken place in five circles i.e. Uttarakhand,
Rajasthan, Chhattisgarh, Haryana and Gujarat. So far as
Maharashtra Circle is concerned, admittedly, no malpractices have
been reported, except Amravati and Nagpur Centres,

6 In the matter involving identical facts, (Civil Appeal
No.10513 of 2016), the Hon'ble Apex Court has passed the
following order:
"Those persons who are not suspected of
having committed any malpractices and who
have undergone the prescribed courses may be
reinstated with all consequential benefits and
50% back wages, with liberty to the
respondents to take action against them in case
subsequently it is found in the investigation
that they have indulged in some malpractices.
We make it clear that the respondents are
at liberty to take action against these persons
who have violated the terms of the examination
such as having appeared in more than one
centre. Such violations will also be treated as
mal practices.
We further make it clear that this
order will not enure to the benefit of those
persons who have not been given appointment
letters. However, we also make it clear that
those candidates who have not completed the
course but were in the process of completing
the course until the impugned action was taken
may be permitted to complete the
course/training provided they are not suspected
of any malpractice."
7 Since it is noticed that candidates appearing from
Maharashtra Circle, except Amravati and Nagpur centres, are not
reported to have been involved in the malpractices, such of those

candidates, who do not alleged to have been involved in the
malpractices, can be extended benefit of the orders passed by the
Hon'ble Apex Court, referred to above.
8 It has not been contended by the respondents that any
of the petitioners before us is suspected of having involved in the
malpractices at the examination. In this view of the matter, such
of those petitioners, who have undergone the prescribed training
and reported on duty, shall be reinstated with all consequential
benefits and 50% back wages. So far as petitioners, who have not
completed the training, but who are in the process of completing
the training or did not join the training until impugned action was
taken, are permitted to complete the course/training. As has been
observed by the Hon'ble Apex Court, this order will not enure to
the benefit of those persons who have not been given appointment
letters.
9 In view of above, writ petitions are allowed to the
extent specified above. Respondents shall take consequential steps
pursuant to this order, as expeditiously as possible, preferably
within a period of eight weeks from today.
10 Rule is made absolute to the extent specified above.
No order as to costs. Pending Civil Applications, if any, stand
disposed of.
