Since the issue involved in the Writ Petitions is identical and
since similar prayers are made therein, they are heard together and are
decided by this common judgment.
Rule. Rule made returnable forthwith. The Writ Petitions are
heard finally at the stage of admission, with the consent of the learned counsel
for the parties.
By these Writ Petitions, the petitioners seek a direction against
the respondent-Scrutiny Committee, to decide the caste claim of the
petitioners within a time-frame. The petitioners challenge the show-cause
notice issued by the Collector, Chandrapur, asking the petitioners as to why
they should not be disqualified from holding the post of Sarpanch, Upsarpanch
and Member of the Village Panchayat, in the absence of the caste validity
certificate.
Ms. P. D.Rane, the learned counsel for the petitioners submitted
that the Collector, Chandrapur is not justified in issuing the show cause notice

to the petitioners as the caste claim of the petitioners is duly referred to the
Scrutiny Committee, by the Tahsildar. It is stated that the caste claim of the
petitioners is not decided by the Scrutiny Committee till date and hence the
petitioners cannot be penalised for the pendency of the caste claim, in view of
the inability on the part of the Scrutiny Committee, to decide the same within
a stipulated time. It is stated that in the circumstances of the case, a direction
to the respondent-Scrutiny Committee to decide the caste claim of the
petitioners would be necessary. It is stated that the petitioners should not be
disqualified, till their caste claim is decided.
Mr. V.P. Maldhure, the learned Assistant Government Pleader
appearing on behalf of the Scrutiny Committee states on instructions, that the
caste claim of the petitioners is pending before the Scrutiny Committee and
the same would be decided as early as possible. It is stated that the Collector
had issued the show- cause notice as, it is necessary under the provisions of
the Act and the Rules to submit the caste validity certificate within the
specified time.
In view of the statement made on behalf of the Scrutiny
Committee that the caste claims of the petitioners are pending before the
Scrutiny Committee, it would be necessary to allow the Petitions as the
petitioners are not at fault in not producing the caste validity certificate. The

caste claims of the petitioners were duly remitted to the Scrutiny Committee
for verification through the competent authority. If the caste claims of the
petitioners are not decided by the Scrutiny Committee within the time
specified under the provisions of the Act and the Rules, the petitioners cannot
be blamed for not producing the caste validity certificates. In this background,
it would be necessary to grant the relief sought by the petitioners in these
petitions.
Hence for the reasons aforesaid, the Writ Petitions are allowed.
The impugned show-cause notices are quashed and set aside. The Scrutiny
Committee is directed to decide the caste claim of the petitioners as early as
possible and positively within fifteen months. Since the petitioners were not
at fault in not producing the caste validity certificate, the respondent -Collector
or any other respondent should not take action for disqualification of the
petitioners, either as Sarpanch/Upsarpanch or Members of the Gram
Panchayat, till the caste claim of the petitioners is decided.
Rule is made absolute in the aforesaid terms, with no orders as to
costs.
