THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO

CONTEMPT CASE NO: 6554 of 2023
ORDER:

This Court vide order, dated 08.05.2023 in W.P.No.3628 of 2021

directed the respondents herein to apply the minimum time scale to

the employees in the writ petition relying on the judgment of the

Hon'ble Apex Court in State of Punjab and others vs. Jagjit Singh

and others1. The said order was not complied with as there is no

specific time prescribed by this Court.

2. For not compliance of the said order, the petitioners herein have

filed the present contempt case. The contempt case underwent

several adjournments on several grounds and eventually, the

Government has come up with an affidavit stating that they are

inclined to implement the order, dated 08.05.2023 of this Court subject

to the outcome of the writ petition and requested to grant six months

time to implement the orders of this Court. If the same is allowed

virtually it amounts to exonerate the contemnors from the contempt

case.

3. Since this Court declined to grant six months time as prayed in

the affidavit, however, the respondents are granted eight weeks time

from today for implementation of the order, failing which it amounts to

further contempt.

(2017) 1 SCC 148

4. Accordingly, the Contempt Case is closed. There shall be no

order as to costs.

As a sequel thereto, miscellaneous Petitions pending, if any,

shall stand closed.
