The present petition has been filed in public interest highlighting the inaction of the official respondents in not complying with the directions of the Apex Court pertaining to road safety issues dated 29.03.2022 and the judgment of the Bombay High Court in the case of The High Court on its own Motion, High Court of Judicature at Bombay vs. The State of Maharashtra and others in P.I.L.No.71 of 2013.

The Apex Court directed that Committees on Road Safety be constituted at the district level. The Committees were also required to meet on fortnightly basis on a virtual platform and on a monthly basis physically. The minutes of the meetings were also required to be made available on the relevant web site. The Committees were also required to publish road accident data on a monthly basis on a public domain as also prepare and

develop a District Road Safety Plan. The Committees were also required to ensure optimal placements of ambulances to help improve response time and hand over time to hospitals in the case of accidents and prepare an Emergency Medical Plan for mass fatality accidents in the district.

Pursuant to the directions so issued, it appears that the government issued a Government Order bearing G.O.Ms.No.8, Transport, Roads and Buildings (TRP.I) Department, dated 22.04.2022, whereby, committees have been constituted at the district level. However, whether the mandate and the spirit and the directions of the Apex Court have been complied with on ground is required to be seen.
