THE COURT MADE THE FOLLOWING JUDGMENT:
This Second Appeal is filed aggrieved by the Decree and Judgment
dated 16.07.2007 in A.S.No.65 of 2004 on the file of the Special Sessions
cum X Additional District Judge, Krishna at Machilipatnam, confirming the
Decree and Judgment dated 27.03.2004 in O.S.No.246 of 2002 on the file of
the Court of I Additional Junior Civil Judge at Machilipatnam.
2. Today, when the matter is taken up, learned counsel for the appellant
submits that despite his best efforts, he could not get instructions from the
appellant as well as from the trial Court advocate.
3. It seems that the appellants herein have no interest to prosecute the
appeal otherwise they could have proceeded with the matter.
4. Hence, this Court has no other alternative but to dismiss the appeal.
5. In the result, the appeal is dismissed for default. There shall be no
order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
