The Court made the following Order:

The respondent herein, had moved O.S.No.126 of 2019, in the Court of

the learned Junior Civil Judge, Piduguralla, for recovery of an amount of

Rs.7,83,453/- . This suit was decreed, by way of an ex-partee order, dated

27.11.2019.

2. The petitioners herein, having come to know of the judgment and

decree, had moved I.A.No.57 of 2023, for setting aside the said ex-parte order

and decree. Along with I.A.No.57 of 2023, an application for condonation of

delay for filing of the said application was also moved and allowed.

3. I.A.No.57 of 2023 has been pending since, february-2023 and has

undergone about 28 adjournments.

4. The petitioners being aggrieved by the non-disposal of the I.A.No.57 of

2023, have approached this Court by way of the present Civil Revision

Petition.

5. It is the contention of the petitioners that, while the present application

was kept pending, the respondent has moved before the learned Principal

Junior Civil Judge, Miryalaguda in E.P.No.1 of 2021, on the basis of the

judgment and decree, dated 27.11.2019 and is now seeking to obtain orders

of detention in civil prison against the petitioners.

6. In the aforesaid circumstances, this Civil Revision Petition is disposed

of with a direction to the learned Junior Civil Judge, Piduguralla to consider

and dispose of I.A.No.57 of 2023, at the earliest, and preferably within a

period of four (04) weeks from the date of receipt of this order. There shall be

no order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
