THE COURT MADE THE FOLLOWING JUDGMENT:
The Second Appeal is preferred by the appellant against the
judgment and decree dated 02.08.2004, passed in A.S.No.19 of 2003 on
the file of the Additional Senior Civil Judge, Gudivada.
2. As learned counsel for the appellant was elevated as Judge of the
Bench of the Court, this Court ordered notice to the appellant and the
notice was sent to the address shown in the appeal, but it was returned
with an endorsement 'left without instructions'. It seems that the appellant has no interest to prosecute the appeal, hence, this Court has
no other alternative except to dismiss this appeal.
3. In the result, the Second Appeal is dismissed for default. There
shall be no order as to costs.
Interim orders granted earlier, if any, shall stand vacated.
Miscellaneous petitions pending, if any, in this appeal shall stand
closed.
