I.A.No.1 of 2024 It is stated that the Petitioners were enlarged on bail suspending the sentence passed against them in NDPS Sessions Case No.19 of 2009 dated 09.05.2011 by the I Additional District and Sessions Court-cum-Special Judge for the Trial of Cases under NDPS Act, Rajamahendravaram. Against the conviction and sentence, the Petitioners preferred the present appeal vide Criminal Appeal No.576 of 2011 challenging the validity and correctness of the same.
Vide orders in Crl.A.M.P.No.1363 of 2011 dated 02.09.2011 the sentence passed against the Petitioners is suspended and they were released on bail on some conditions. By an order dated 28.08.2023, this Court revoked the order of suspension and release of the Petitioners on bail holding that conduct of the Petitioners is against the spirit of the bail bonds executed by them, and directed to issue Non Bailable Warrant against the Petitioners.
In pursuance of the said order of execution of Non Bailable Warrant, Petitioners were arrested and remanded to judicial custody since April, 2023.
When the appeal came up for hearing, Sri Duvvuri Surya Narayana, learned Senior Counsel appearing for learned counsel for the appellants submitted their arguments.
As appeal may take some time for disposal, it is desirable to allow the petition by suspending the sentence and release the Petitioners on bail.
Considering the facts and circumstances of the case, sentence of imprisonment imposed by the trial Court alone is suspended, pending disposal of the criminal appeal. The Petitioners are ordered to be released on bail on their executing personal bond for Rs.25,000/-(Rupees Twenty Five Thousand Only) each with two sureties for like sum each to the satisfaction of Special Sessions Judge for Trial of Cases under NDPS Act-cum-I Additional Sessions Judge, East Godavari District at Rajahmundry.
