The Court made the following:

This appeal is filed under Section 96 of C.P.C against the

Decree and Judgment in O.S.No.208 of 2006 on the file of Senior

Civil Judge, Madanapalli, Chittoor District, dated 17-06-2009.

02. As seen from the record, appeal was dismissed for default

against sole respondent vide order dated 13.04.2017, despite

posting the matter under the caption 'for dismissal', none

appeared on behalf of appellant.

It seems so far no steps have been taken to set aside the

default order passed against the sole respondent.

03. In the result, the Appeal is deemed to be dismissed for

default as per order dated 13.04.2017. No order as to costs.

Consequently, miscellaneous petitions if any, stand closed.
