The Court made the following Judgment:

This appeal is filed under Section 100 of C.P.C against the

Decree and Judgment in A.S.No.49 of 1992 dated 02.08.2001 on

the file of Senior Civil Judge, Gudivada confirmed the decree and

Judgment in O.S.No.43 of 1986 on the file of Junior Civil Judge,

Gudivada dated 23.09.1992.

02. On behalf of appellant, Sri T.S.Anand, is no more, this court

directed Registry to issue notice to the appellant. The notice

issued to appellant Nos.2, 4 and 5 were returned with an

endorsement 'insufficient address'. On verification, it is noticed

that the address referred in the appeal to the same address

notice sent to the appellants, but they were returned. Despite

sending of notice to Appellant No.3, it is returned with

endorsement, 'no such person'. Despite service of notice on

Appellant No.6 did not choose to engage counsel nor appeared.

Sri Y.Srinivasa Murthy, who holds joint vakalat along with

Sri T.S.Anand, he has no instructions. Despite sending notice to

the appellants to the address shown in the appeal, there is no

response from the appellants. It seems appellants have no

interest in proceeding with the appeal.

03. In the result, the Second Appeal is dismissed for default.

No order as to costs.

Consequently, miscellaneous petitions if any, stand closed.
