The Court made the following:
JUDGMENT:

The instant appeal under Section 378(4) of Code of Criminal

Procedure, 1973 has been filed by the appellant, seeking to set aside the

judgment passed in C.C.No.782 of 2015, by the Additional Judicial Magistrate

of I Class at Kavali, for the offence punishable U/Sec.138 of the Negotiable

Instruments Act, acquitting the 1st respondent/accused.

2. When the matter is taken up for hearing, Sri K. Maheswara Rao,

learned counsel for the appellant, sought permission of this Court to withdraw

the matter and endorsed the same on record.

3. Permission is accorded.

4. In the result, the Criminal Appeal is dismissed as withdrawn.

Pending miscellaneous petitions, if any, shall stand closed.
