iV Addl. Junior Civ vil Judge, Kakinada which was confirmed in Cri. Agpeal Na,
4772020 ate 5-7-2024 on the file of 1) Addi, Sessions Judge, East Godavari at
Kakinada, and to enlarge the pelfioners on bell, pencing disposal of
ORLRC No 80e of 2024, on the fle of the High Court.
The court while directing issue of notice to fhe Respondents herein to
show cause as fo why this apnlication should net be complied with, made the
following order The receipt of this order wil be deemed fo be the receipt of
notice in the case}.
ORDER:
"Heard the learned counsel for the petitionersiAT & Az. >
Perused the record.
This application is fied under Section J97(1} of Cr.P.l, seeking
suspension of sentence and release the petitioners/Al & Ag on ball. ~
Both Courts below concurrently found the petitioners/A? & Aa&
quilty for the offence punishable under Sections 420 and 468 read with
34 af the indian Pena! Code.
The learned counsel for the petiioners/AT & Ag submits that in
obedience to the judgment of the Appellate Court, the petitioners/A? &
A2 are now in prison serving the sentence. i
Since the revision and its disposal would fake same time, and after
considering the submissions, this petition is allowed, suspending the
sentence passed by the learned Hl Additional Sessions Jisige, Kakinada,
in Criminal Apneal No.1? of 2020, dated 08.07.2024. The netitioners/At &
A? shall be released on ball on their executing personal bond for a sum
of Rs.10,000/- (Rupees Ten Thousand only} each with hwo sureties for a
like sum each, to the satisfaction of the learned I¥ Additional Judicial
First Class Magistrate-cum-[V Additional Junior Civil Judge, Kakinada."
