The learned counsel for appellant, Mr.Bala Subrahmanyam,
represented through virtual hearing would submit that he has not
received any instructions from the appellant with regard to
settlement of dispute between the parties out of Court as
represented by the learned counsel for respondent. There is no
representation for respondent. Learned counsel for respondent already represented before this Court that matter has been settled
out of Court.
2. As the matter is said to be settled out of Court and learned
counsel for appellant not ready to proceed with hearing though the
matter is listed under the caption of dismissal, this second appeal is
dismissed for default. No order as to costs.
Consequently, miscellaneous petitions if any shall stand
closed. The Interim stay granted if any, shall stand vacated.
