THE COURT MADE THE FOLLOWING JUDGMENT:

On 06.08.2024, the learned counsel for the appellant

submitted that despite their diligent efforts, they have been

unable to obtain regarding the date of the appellant's death and

the legal representatives of the appellant are not interested in the

pursuing the appeal.

2. In the said facts of the case, on 06.08.2024, the matter was

directed to be listed to today under the caption "For dismissal".

3. Even today, when the matter is called, there is no

representation on behalf of the appellant. It appears that the legal

representatives of the appellant are not evincing any interest in

prosecuting the appeal.

4. Hence, the appeal is dismissed for default. There shall be

no order as to costs.

Miscellaneous petitions pending, if any, in this appeal shall

stand closed.
