Today when the matter is taken up for hearing, learned counsel

for the appellant has represented that the sole-appellant in the

present appeal had passed away during the pendency of the appeal

and he has no instructions from the Legal Representatives of the

deceased sole-appellant and requested to pass necessary orders. The

representation made by the learned counsel for the appellant is

recorded.

2. Therefore, the appeal suit is dismissed as abated. No costs.
