CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE R RAGHUNANDAN RAO

DATE : 8th August, 2024

PC:

The present writ appeal has been preferred against the judgment and

order, dated 09.01.2024 in W.P.No.656 of 2024.

2. By virtue of the said order, the learned single Judge disposed of

the writ petition filed by the petitioners (respondent Nos.1 & 2 herein) with a

direction to respondent No.5 herein to consider the application dated

16.12.2023 under the provisions of the A.P Gram Panchayat Act, 1994 and

pass orders within a period of two weeks.

3. In our opinion, the aforementioned order is quite innocuous and

does not in any manner affect the rights of the appellant herein, who claims

HCJ & RRR,J WA_585_2024

that under the guise of the aforementioned order, the petitioners (respondents

No.1 & 2 herein) are pressurizing respondent No.5 herein to treat the said

order as some sort of a direction under which they have no option but to grant

permission. In our opinion, such a presumption is without any basis. We do

not see any reason to interfere with the judgment and order impugned.

4. The Writ Appeal is found to be without any merit and is

accordingly dismissed. No order as to costs.

Miscellaneous applications pending, if any, shall stand closed.
